The parties to this action will he designated as they appeared in the trial court. One James Corrigan, as* plaintiff, instituted suit against the Oklahoma Coal Company, a corporation, as defendant, for damages for personal injuries alleged to* liave been sustained by the plaintiff on account of the negligence of the defendant company. The defendant company filed a demurrer to the plaintiff’s petition, on the ground that the petition did not allege facts sufficient to constitute a cause of action.
