United States v. Corey Vampelt Fogg

Court of Appeals for the Eighth Circuit

Decided September 8, 2016No. 15-3078Published

1Concurring in part, dissenting in partBright, Circuit Judge

I concur with the majority that the district court did not abuse its discretion by excluding evidence under Fed. R. Civ. P. *957403. But the majority improperly concludes recent Supreme Court decisions undercut Corey Fogg’s (Fogg) arguments regarding the application of the Armed Career Criminal Act (ACCA), 18 U.S.C. § 924(e) sentencing enhancement. I disagree with the majority’s conclusion and respectfully dissent.2
