This is an action for malpractice against an osteopathic physician and surgeon. The jury returned a verdict for the defendant which the court set aside. The defendant appeals.

The plaintiff, a woman 55 years of age, sustained a Colles’ fracture of her right wrist as the result of a fall on an icy stepping stone in her hack yard. She consulted the defendant, who sent her to the Portland Osteopathic Hospital where he reduced the fracture.
