About 3 o’clock in the afternoon of January 16, 1920, Clifton Porter Nunnelley, an 8-year-old boy, was killed *353in Fayette county on the Bryant Station turnpike by a Ford truck driven by John Muth. The father of the boy qualified as his administrator and filed this suit for .$30,-000.00 damages against John Muth, Pierre Muth, Henrietta Muth and Louis Muth, alleged to be partners doing business under the name and style of Muth Grocery Company.
