Plaintiff herein filed bis petition in circuit court for a declaratory decree pursuant to tbe provisions of CL 1948, § 691.501 et seq. (Stat Ann § 27.501 et seq.). Tbe record does not indicate any dispute as to the material facts. In 1935 plaintiff and one Alma Harris entered into an agreement pursuant to which they lived and cohabited together for a number of years. Had there been no legal impediment to their marriage, it is conceded that a valid common-law marriage would have resulted.
