LAY, Circuit Judge.
This is an appeal from an order of the United States District Court for the Western District of Missouri, St. Joseph Division, which granted appellee-creditor’s motion to dismiss a bankrupt’s ancillary petition for injunction. Rondle Lee Robertson (hereinafter bankrupt) and his wife executed a promissory note to the Interstate Securities Company (hereinafter creditor) in December 1966, in the sum of $1,872.
