Following surgery and subsequent injuries to her arm, Kathleen Samuel (“Samuel” or “Appellant”) filed the underlying medical mal-, practice claim in the Superior Court, naming as defendants the Government of the Virgin Islands, Dr. Cheiyl Wade and other unidentified physicians. The appellees moved for summary judgment, on grounds Samuel’s April 1999 claims, arising from her August 1996 injuries, were barred by the applicable statute of limitations and by her failure to comply with the notice requirements of the Virgin Islands Tort Claims Act.
