At the May term, 1945, of the Circuit Court of Nicholas County, Homer Underwood, Hazel Underwood,. Buster Underwood, Glen Brock and Ira Ramsey were indicted for an alleged assault upon and the unarmed robbery of Fred Mullens. They gave bond for their appearance at the succeeding August term, and at that term and the November term, 1945, the trial of the indictment was continued on motion of the State.
