MONROE, Judge.

This is an appeal from a judgment on a petition seeking the return of certain personal property to an estate.

In December 1992, 69-year-old Willodean Duke Cray was taken to a hospital emergency room. At first it was thought that she was suffering from gallbladder problems, but it was later determined that she had suffered a major heart attack and would have to undergo open heart surgery.
