This was an action by the appellee against the appellant ahd others, to reform a mortgage executed by one James O’Brien to the plaintiff) and to foreclose the same. There are three tracts of land mentioned in the mortgage, ■one of which is the south-east quarter of a designated section, and it is alleged that the south-west quarter of the section was intended. The appellant was made a defendant, because he was the owner, by assignment, of several judg*285ments which had been rendered against the mortgagor after the execution of the mortgage.
