I. INTRODUCTION

This case represents another chapter in the continuing saga of inmate violence in our nation’s prisons. While an inmate at the Cummins Unit of the Arkansas Department of Corrections, Respondent John Nes-bitt (Nesbitt) was stabbed by fellow inmate Kenny Hamm (Hamm). Nesbitt, a pro se complainant, brought suit under 42 U.S.C. § 1983, seeking money damages and in-junctive relief. The magistrate judge 1 entered judgment for Nesbitt and against Petitioner Lieutenant T.S. Falls (Falls) in the amount of $250; and the magistrate enjoined Falls from housing…
