The instant case involves a discretionary appeal from the Chancery Court of Dyer County. Grooms Herron, *639Chancellor, sitting by interchange, overruled appellant’s demurrer to the bill and granted a discretionary appeal to this Court.

In this opinion the parties will be referred to as they appeared in the trial court; that is, Mrs. W. L. Sanders, Administratrix of the Estate of W. L. Sanders, deceased, as complainant, and Forcum-Lannom, Inc., as defendant.
