Affirming.

The appellant, Jim Stahl, shot and killed W. M. Hammonds on July 12, 1930. An indictment was found against him charging him with the murder of Hammonds and on his first trial the jury failed to agree. At the second trial he was convicted of manslaughter and sentenced to a term of five years in the state penitentiary. On this appeal he relies upon the following grounds for reversal of the judgment: Errors in the instructions, admission of incompetent evidence, and misconduct of the commonwealth’s attorney in the interrogation of the commonwealth’s…
