This is a suit by a judgment creditor of an insolvent corporation to recover from certain of its stockholders the sum alleged to be due from each, respectively, on- account of stock subscription. The facts are that the Citizens’ Real Estate & Investment Company, having been duly incorporated under the laws of the State of Oregon with a capital stock of $500,000, divided into five thousand shares of the par value of $100 each, adopted by-laws containing the following provision: “The stock of this corporation shall be paid for in monthly installments of five per cent, upon the par value…
