MAYER, District Judge.

[1] The Fleming patent, No. 803,684, so far as concerned a detector for radio waves, was fully discussed in Marconi v. De Forest (D. C.) 236 Fed. 942, affirmed 243 Fed. 560, 156 C. C. A. 258. The effect of the decision supra of this court, as affirmed by the Circuit Court of Appeals, supra, was to accord to Fleming’s invention a high place in the art.
