Appeal from Linn District Court. The defendant was indicted for tbe murder of one Mund-brood. He was convicted of tbe crime of manslaughter, and lie appeals.

I. It appears from tbe evidence in tbe case that tbe defendant and bis brother, Max Eroelick, boarded i. homicide: questíon'for1 •|Ury' an(l lodged at tbe home of one Chick, in the city of Cedar Rapids. They were at said bouse at about half past eight o’clock in the evening, at which time Mundbrood, one Hinkleman and another party came there. These parties, with Chick and his wife, all being *214present, two of them went out, and returned witb a jug of whiskey, of which they all drank.
