MEMORANDUM OPINION AND ORDER

I. Introduction.

Joann Gwynn brings this action for damages under 42 U.S.C. § 1983, asserting violations of the Fourth, Fifth, Eighth, Ninth and Fourteenth Amendments to the Constitution of the United States, against TransCor America, Inc., a Tennessee corporation, and its former employees, Jack ter Linden and Randy Goodman. She also asserts state law claims for negligent supervision (against TransCor); sexual assault and battery (against TransCor and ter Linden); and outrageous conduct (against all Defendants).
