Burch, J.:

The proceeding was one to forfeit an automobile used in transporting intoxicating liquor as a common nuisance. Judgment of forfeiture was rendered, and a mortgagee of the automobile, who intervened, appeals.

The automobile was discovered standing in front of the Lipton hotel in the city of Downs, with liquor dripping from it. Under direction of the mayor the city marshal took possession of it. The county attorney was notified, and a John Doe warrant was issued under which Dennis Morris was arrested. Two days later, and on April 19,1926,…
