LEWIS, Judge.
The two issues in this case are: 1) whether the trial court erred in finding that it had subject matter jurisdiction over this action and 2) whether the trial court erred in granting the plaintiff’s motion for judgment on the pleadings.
Thomas E. Brickhouse, Sr. died on 18 August 1989 in Norfolk, Virginia. He was a resident of Suffolk, Virginia. He was survived by his wife, Margie Brickhouse, who is the defendant in this case, and his son, Thomas E. Brickhouse, Jr., who is the plaintiff in this case.
