The city of Carterville at all times hereinafter mentioned, was a city of the' fourth class in Jasper county, Mo. The defendant was convicted in the police court of the city, on a complaint filed, charging him with the violation of one of the ordinances of the city. He appealed to the circuit court and *36there entered a plea of guilty and a fine of five dollars was assessed. The clerk in entering- up the costs included a fee of twenty-five dollars for the city attorney. A motion was filed by the defendant to retas that item of costs. The motion'was overruled and the defendant appealed.
