CAVE, Presiding Judge.

This is an original action in prohibition, filed in ' the St. Louis Court of Appeals, wherein relator seeks to prohibit the respondent, Judge of the Circuit Court of St. Louis County, from further exercising jurisdiction in a quo warranto proceeding brought against relator in that court.

The St. Louis Court of Appeals, in an opinion reported in 260 S.W.2d 800, quashed its preliminary rule in part and made it *291absolute in part. Thereafter, upon timely motion of the relator, we ordered the cause transferred to this. Court, and we will consider the matter as if the proceeding…
