The defendant has appealed from a conviction and sentence for having intoxicating liquor, called moonshine whisky, in his possession for beverage purposes.

When the bill of information was filed in the district court, and before the case was called for trial, the defendant asked for an order of court to forbid the district attorney to offer the whisky in evidence or to offer any proof of the finding of the whisky in the defendant’s possession.
