MEMORANDUM AND ORDER

KATZ, Senior District Judge.

Defendant Pasquale DeTommaso pled guilty before this court to three counts of making false declarations on his tax returns, in violation of 26 U.S.C. § 7206(1). The government and the defendant agree that the offense level for sentencing purposes is 13, 1 which provides a sentencing range of 12 to 18 months as the defendant has no prior criminal history.
