On October 19, 1938, appellant entered a plea of guilty to the charge of second degree burglary, and the judgment of the court was, that the defendant be and is hereby committed to the Indiana State Prison and the Board of Trustees thereof for a period of not less than two years and not more than five years, etc.
Appellant was 36 years old at the time judgment was entered. He contends by this appeal that the judgment should have been for a determinate period of not less than two years and not more than five instead of an indeterminate period. This is the only question presented by the record.
