The several assignments of error present for determination but a single question: Did the cause of action stated in the amended complaint die with the person of Edward S. Kelley, or did it survive to his personal representative?

The maxim, “ Actio personalis moritur eum persona,” is as old as the common law itself. Nevertheless, for more five hundred years, or since the reign of Edward the III., the rule has been the subject of legislative modification both in England and America.
