This suit was instituted in the Lafayette circuit court for the recovery of damages for injuries alleged to have been received by plaintiff, in consequence of the unsoundness of a hack used by defendants, as commou carriers, in transporting persons from the depot of the Missouri Pacific Railroad, in the city of Lexington, to different points in said city.
