HILL, Circuit Judge.

Appellee Jackson sued appellant, The City of Kansas City, Kansas, seeking recovery under provisions of K.S.A. 12- 201, 1 2 the “mob statute”. Mrs. Jackson was awarded judgment in the amount of $20,000. Defendant appeals on the grounds that (1) plaintiff has not stated sufficient facts to bring the case within the mob statute; (2) the court erred in refusing to give defendant’s requested instructions 2, 4 and 5; and (3) the court erred in instructing the jury as to the law in the case.
