This case is before the Court on Defendant Norfolk Southern Railway Company’s Motion for Summary Judgment on Plaintiffs Count I, filed on February 29, 2000, and Defendant Douglas A. Drewery’s Motion for Summary Judgment on Plaintiffs Count II, filed on June 1, 2000.
