In this case a novel question is presented: whether administrative materials copyrighted by private parties are subject to the disclosure provisions of the Freedom of Information Act (FOIA). 1 We hold that the mere existence of copyright, by itself, does not automatically render FOIA inapplicable to materials that are clearly agency records.
