OPINION

DALLY, Commissioner.

This is an appeal from a conviction for the offense of burglary of a habitation, a violation of V.T.C.A. Penal Code, Sec. 30.02. After accepting the appellant’s plea of guilty, hearing the. evidence and argument of counsel, the court assessed the appel lant’s punishment at imprisonment for seven years.

The appellant asserts that the indictment is fundamentally defective since it does not state with sufficient particularity where the offense occurred in Harris County.
