This is an action by the appellee against the appellant for injuries received by the plaintiff while working in the coal mine of the plaintiff.
There was a certain “skidway” extending from the mouth to the bottom of the air. way in said mine, said skidway having three-cornered pieces of timber bolted to crossties, thus forming a groove or trough, in which, a large bucket about 30 inches in diameter and 4 feet deep, which slid on its side in said trough, was raised and lowered by a rope attached to a windlass or drum in the engine room at the mouth of the mine.
