The record in this case sets forth a somewhat exceptional state of facts. Harold St. Clair Johnson died in June, 1896, leaving an estate of about $60,000. His heirs at law were two brothers, Henry and Oscar, and three sisters, Josephine, Sarah and Susan, all now living. No will of Harold’s could be found when he died, and all concerned supposed he had left none. Thereupon an administrator was appointed upon Harold’s estate, and it was settled as an intestate estate.
