On January 31, 2003, the Official Committee of Unsecured Creditors (the “Committee”) of the Enron Corporation and its affiliated debtors and debtors in possession (the “Debtors”) brought an adversary proceeding in the U.S. Bankruptcy Court for the Southern District of New York seeking the avoidance and recovery of alleged fraudulent transfers by defendants Kenneth L.
