MEMORANDUM AND ORDER

STERLING, District Judge.

This is a civil damage suit brought by the plaintiff, Beverly Ann Gray (Gray), against a drug company, Eli Lilly and Company (Lilly), and the United States. Plaintiff alleges that she has been harmed by a drug diethylstilbestrol (DES), taken by her mother during Gray’s period of gestation.- The pleadings and affidavits indicate that DES was dispensed by physicians in the early 1950’s to pregnant women with histories of miscarriages in order to avoid problem pregnancies.
