Plaintiff Umar Oriental Rugs (hereinafter “Umar” or “plaintiff’) brought this negligence action against defendant Carlson & Carlson (hereinafter “Carlson” or “defendant”). Defendant moves for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure, arguing that the doctrines of res judicata and collateral estoppel bar plaintiffs claims.
