Loring, Chief Justice.
This is an action brought by J. Braufman, d. b. a. American Jobbing Company, to recover possession of certain printed and unprinted paper or its value in lieu thereof. At the time this action was commenced, defendant had possession of the disputed paper and was holding it under a claim of lien for storage and for work and labor performed in connection with it. The ease came on for trial before the district court without a jury, and at that time plaintiff withdrew any and all claim to the disputed paper which was printed.
