OPINION AND ORDER GRANTING DEFENDANT’S MOTION TO DISMISS COUNTS III, IY AND V OF PLAINTIFF’S FIRST AMENDED COMPLAINT
GADOLA, District Judge.
On September 11, 1991, plaintiff filed the instant action alleging, among other things, unfair competition and antitrust violations by defendant Sweetheart Cup Company. Defendant subsequently filed a motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(6). The motion was initially dismissed without prejudice for defendant’s failure to seek concurrence.
