SOMERVILLE, Judge.

Defendant Eddie Brunson, who was tried in the Circuit Court of Jackson County, was found guilty by a jury of the crime of burglary, second degree (Section 560.-045, RSMo 1969, V.A.M.S., and, in view of the jury’s inability to agree on his pun ishment, was sentenced by the court to three years confinement in the Department of Corrections.
