Appeal from a judgment of the superior court for Spokane county, Sullivan, J., entered January 5, 1911, upon findings in favor of the plaintiff, after a trial before the court, in an action for personal injuries sustained by a laborer in a ditch.

The plaintiff commenced this action in the superior court for Spokane county, to recover damages for personal injuries alleged to have been received by him as the result of the defendant’s negligence while in his1 employ as a laborer in digging a sewer ditch, in Spokane. The cause was tried before the court without a jury, resulting in find*213ings and a judgment awarding the plaintiff $300 damages, from which the defendant has appealed.
