The appellant was charged with murder in the second degree, convicted of manslaughter in the first degree, and sentenced to ten years imprisonment. From this judgment he appeals.

From the evidence it appears that in Opelika on the evening of November 5, 1970, a card game was in progress at the home of the deceased, Sarah Ingram. Engaged in the game and otherwise in attendance as visitors were twelve or more persons.
