CLARK, Supernumerary Circuit Judge.
Appellant was tried on an indictment charging murder in the first degree, convicted of murder in the second degree and sentenced to imprisonment for thirty years.
The deceased was Ollie Williams, affectionately known as “Coon” and endearingly addressed by the younger set as “Uncle Coon.” He was celebrating his threescore and fifth birthday the night he was killed.
