I. Introduction

James N. McCormick (“Debtor”) filed a voluntary Petition under Chapter 7 of the Bankruptcy Code on December 21, 2001. The Mountbatten Surety Company, Inc. (“Mountbatten”) timely filed a Complaint to Determine Dischargeability of Debt under Section 528(a)(4). 1 Presently before the Court is Debtor’s Motion to Dismiss the Complaint for failure to state a claim upon which relief can be granted.
