Appeal by the defendant, Lewis Y. F. Randolph, as president of the Consolidated Stock and Petroleum Exchange of ¡New York, from an order of the Supreme Court, made at the ¡New York Special Term and entered in the office of the clerk of the county of New York on the 24th day of November, 1905.

Ingraham, J.:

This action was tried before Hr. Justice Clabke, who announced ’that, he had determined it in favor of the defendant, filing an 'opinion stating the grounds of his decision. Before the decision was signed or judgment entered Hr. Justice Clabke was designated as a justice of the Appellate Division in this department, whereupon, *540on motion of the plaintiff, the corirt at Special Term set the case down for a new trial, and from.that order the defendant appeals.
