NEBEKER, Associate Judge:
Appellant, James R. Hall, contests the dismissal of his tort claim against appellee, Washington Metropolitan Area Transit Authority (hereinafter WMATA). As an employee of WMATA, Hall was arrested on March 21, 1979, and charged with embezzling $8.00 from a subway farecard machine. He was acquitted of the charge. On April 2, 1981, he filed this action against WMATA, alleging false arrest, malicious prosecution and abuse of process.
