The plaintiff in error, hereinafter called defendant, was convicted in the district court of Carter county on a charge of manslaughter in the first degree, and sentenced to a term of 15 years in the state penitentiary.

A brief statement of facts, as gathered from the record, is about as follows: On the night of February 1, 1924, defendant, who was a constable, attended a dance at the residence of one Hanway, near the little village of Cheek.
