Plaintiff, her husband and their three-year-old daughter, Dina, were residents in an apartment rented from defendant. Dina allegedly sustained injuries as a result of defendant’s negligence in failing to repair a window. A trial before a jury resulted in a verdict for defendant and, on appeal, the Appellate Division affirmed with a divided court.
