Appeal from a judgment of the County Court of St. Lawrence County (Nicandri, J.), rendered May 13, 2002, upon a verdict convicting defendant of the crimes of rape in the first degree and sodomy in the first degree.

On an evening during May 2001, the victim and defendant, her boyfriend’s stepfather, went out to various bars with two of their friends. There came a point when the victim wanted to leave and defendant stated he would drive her home. At that time, the victim and her boyfriend resided with defendant at his *907mobile home.
