Appeal from District Court, Damar County; Newman Phillips, Judge. ' Suit by the Lyon-Gray Lumber Company against the Gibralter Life Insurance Company and another. From a judgment against it, plaintiff appeals.

* Writ of error granted April 4. 1923. This suit was filed by the appellant to enforce a statutory lien for material furnished in the construction of a building owned by the Gibralter Life Insurance Company, a private corporation. The material facts are as follows: On May 27, 1914, the Gibralter Life Insurance Company entered into a contract with John T. Finn, a contractor, whereby Finn was to furnish the labor and material and erect a hotel building in the city of Paris, in Lamar county, on a lot owned by the insurance company.
