DUFFY, District Judge.
This matter is before the court upon the claimants’ motion to dismiss. For the reasons set forth herein, the court denies the claimants’ motion. 1
BACKGROUND
This is a civil action in rem brought pursuant to. the provisions of 18 U.S.C. §§ 981(a)(1)(A) and (C), and 21 U.S.C. § 881(a)(6).
