OPINION AND ORDER
SESSIONS, Chief Judge.
This is a diversity action arising out of an incident in which the plaintiff tripped and fell over a clothing rack while shopping in a T.J. Maxx store owned by Defendant TJX Companies, Inc. (“TJX”). Currently before the Court are TJX’s motion to exclude testimony of proposed expert witness Bill Julio (Doc. 58) and TJX’s motion for summary judgment (Doc. 57). A hearing was held on the motions on January 12, 2006. For the reasons stated below, TJX’s motion to exclude testimony of Julio is DENIED. TJX’s motion for summary judgment is DENIED.
